They totally missed the easement registered on my property. It was not mentioned in the title report and really affected our plans of developing the property land. In addition, the easement by the neighbors had large ficus trees planted which would be destructive to my property, utilities and building. I come to find out about the easement when my neighbor told me about it while we were planning to put a fence and gate. How pathetic was that?. Took the joy out of us having to save all the money to buy this piece of property and come to bear the bad news.
When I asked about this easement, they admitted that they have missed the easement on the report and passed me to the title insurance company (Insurance and report that I paid for upon closing of my escrow)
Title Insurance company they associated with offered a small insulting fraction of the money which was less than I paid for the title insurance all together.
This is the beauty of large corporations like them. Either way they win offering a small amount to settle the claims. Its like returning your any product in a retail store. They just give you less or about the same of what you have already paid for their services while purchasing the home. The loss is always faced by home buyer. I lost my money and part of my property as easement. For them, it is just a plain land however, for us it was totally restricting our future plans.
